Simpliziti, LLC (Simpliziti, We, Our or Us) respects your (hereinafter You or Your) privacy and is committed to protecting it through its compliance with this Simpliziti, LLC Privacy Policy (Privacy Policy). This Privacy Policy discloses how Simpliziti collects, protects, uses and shares your Personal Information (defined below) via its website at www.simpliziti.com (Website) and via its corresponding Simpliziti™ mobile application software (Software) and software as a service (SaaS). Capitalized terms used herein and not otherwise defined shall have the meanings attributed to them in the Terms of Use.
This Privacy Policy applies to Personal Information Simpliziti collects (i) on the Website; (ii) in e-mail, text and other electronic messages between You and the Website or between You and Simpliziti; (iii) and via Your use of the Software and/or the SaaS (including in connection with the creation of any User Account).
This Privacy Policy does not apply to (i) Personal Information collected by Simpliziti offline or through any other means, including on any other website or through any other application; (ii) Personal Information collected by any other person or entity, including WePay, Inc. (please see below).

In using, accessing and viewing the Website, or clicking to accept or agree to this Privacy Policy if and when this option is made available to You, You understand that Simpliziti may collect, use and/or disclose—and You consent to Simpliziti’s collection, use and/or disclosure of—Your Personal Information subject to the terms of this Privacy Policy. As used herein, the term Personal Information means Your name (first and last name), email, postal address, phone number, mobile number, mobile device ID number, date of birth, gender, geolocation, and wish list information, as well as certain information concerning your transactions, namely, the amount of the transaction, to whom and for what amount. This information is currently used for internal purposes, to allow the user to use the Simpliziti application.
This Privacy Policy is effective as of: December 10, 2015 As noted below, this Privacy Policy is subject to change from time to time by Simpliziti and Your continued use of the Website, Software or SaaS after such changes have been made shall be deemed Your acceptance thereof.
Children's Online Privacy Protection Act
Simpliziti complies with the Children's Online Privacy Protection Act of 1998
(COPPA). COPPA requires that web site operators never knowingly
request personally identifiable information from anyone under the age of 13 without requesting
verifiable parental consent. In accordance with COPPA, Simpliziti does not knowingly collect any
Personal Information from children under the age of 13. Simpliziti recommends that no one under the
age of 18 submit Personal Information to the Website or through the Software or the SaaS. In the
event that Simpliziti determines that a user of this Website is under the age of 13, Simpliziti will
use commercially reasonable measures to not maintain or use his or her Personal Information.
Information Collected on the Website/Software/SaaS- What Information Simpliziti Collects
Simpliziti may collect the following information from users of its Website, Software and/or Saas:
- Personal Information (as defined above); and
- information or data that is about You but does not expressly identify You, such as Website usage information, information about Your computer and internet connection and Your IP address.
When is this Information Collected?
Certain of the information provided by Simpliziti on the Website is available without Simpliziti collecting any Personal Information from You. However, Simpliziti does collect Personal Information that You provide voluntarily through the Website, the Software or the SaaS, and when You navigate through the Website.
Simpliziti may collect Your Personal Information when You:
- request information about Simpliziti, the Software, the SaaS or contact customer support through the Website, in which case Simpliziti may keep records of such correspondence and Your corresponding Personal Information;
- subscribe to an e-mail newsletter;
- set up a User Account in connection with the Software or the SaaS;
- send Simpliziti an email message;
- transact business through the Software or the SaaS (including engaging in a financial transaction, in which case Simpliziti may collect details of such transactions in addition to Your Personal Information); or
- otherwise provide Simpliziti with Personal Information.
Simpliziti may collect information or data about You but that does not expressly identify You when You:
- navigate through the Website, in which case data is automatically collected. (Information collected automatically may include usage details, and IP addresses);
You also may provide information to be published or displayed (hereinafter, "posted") on public areas of the Website, or transmitted to other users of the Website, the Software or the SaaS (collectively, "User Contributions"). Your User Contributions are posted on and transmitted to others at Your own risk. Although Simpliziti limits access to certain pages, please be aware that no security measures are perfect or impenetrable. Additionally, Simpliziti cannot control the actions of other users of the Website, the Software or the SaaS with whom You may choose to share Your User Contributions. Therefore, Simpliziti cannot and does not guarantee that Your User Contributions will not be viewed by unauthorized persons.
You have a choice as to whether to provide Simpliziti with any Personal Information.
Although You are not required to disclose any Personal Information to Simpliziti, some portions of the Website, the Software and the SaaS may not be available to You without your providing this information.
In addition to the foregoing, Simpliziti, LLC uses a third party financial services provider, namely, WePay, Inc. to process any financial transactions made in connection with Your use of the SIMPLIZITI® mobile application. Simpliziti itself does not collect your credit card or bank account information; rather, this information, along with certain other Personal Information is collected, stored, maintained and managed by WePay, Inc., and its collection, storage, use and disclosure is subject to WePay, Inc.’s privacy policy and terms of services, which are available at https://www.wepay.com/legal/privacy-policy and https://www.wepay.com/legal/terms-of-service/us. By agreeing to this Privacy Policy, you understand and agree to WePay, Inc.’s privacy policy and terms of service and WePay’s collection, storage, processing, transmission and disclosure of your Personal Information and financial information as set forth therein. You agree that Simpliziti shall have no liability for WePay’s mishandling, misuse, unauthorized disclosure or other actions or omissions concerning WePay’s collection, storage, processing, transmission and/or disclosure of such information.
Use of Your Information
Simpliziti uses the Personal Information You provide in a limited number of ways. Simpliziti may use
Your Personal Information:
- to respond to Your emails sent to Simpliziti;
- to make the Website, Software, and/or SaaS easier for You to use by not making You enter your Personal Information;
- to provide You with information about Simpliziti and its products and services;
- to conduct a transaction that You have requested;
- to verify Your identity and grant access to Your account;
- to carry out Simpliziti’s obligations under any contracts entered into between You and Simpliziti;
- to alert You to updated information and other news and information from Simpliziti; and
- to fulfill any other purpose for which you provide it or, with your consent, for any other purpose.
In addition, Simpliziti may hire other companies to perform services on its behalf such as operating certain aspects of the Website or the SaaS or sending You email. These other companies may be supplied with or have access to your Personal Information for the sole purpose of providing these services to Simpliziti or on its behalf.
Simpliziti may also on occasion combine information about You that Simpliziti has with information it obtains from other parties to enhance Simpliziti’s ability to market to You those products or services that may be of interest to You.
Though Simpliziti will make reasonable efforts to preserve user privacy, Simpliziti may need to disclose Personal Information when required by law or if Simpliziti has a good-faith belief that the action is necessary to comply with a pending judicial proceeding, a court order or legal process served on Simpliziti or to protect its rights or the rights of others, to fight fraud, identity theft, to ensure the integrity and operation of its business and systems, or to protect the rights, property or safety of Simpliziti, its employees, members or others, all of the foregoing as permitted by law.
Control of Your Personal Information; How We Share Your Information
Simpliziti will not disclose Your Personal Information to others without Your permission, except as
explained in this Privacy Policy and as permitted by law. Such Personal Information will only be
used for the purposes set forth herein. Simpliziti may disclose Your Personal Information collected
in accordance with the Privacy Policy to its affiliates, and to fulfill the purpose for which You
provide it. For example, if You provide us with You e-mail address to use an e-mail or contact a
friend, We will transmit such e-mail or contact and Your e-mail address to such individuals.
Currently, Simpliziti is not disclosing information to any third parties, including retailers,
publishers, and advertisers.
Simpliziti does share Your information with other users who you have invited or accepted into your personal network (your Friends) and your name and picture may also be made available to individuals on your Friends’ networks. Such information includes Your name, phone number, email, date of birth, gender, pictures, wish list, and other details you provide in your account. At no time does Simpliziti share any personal financial information with any other users of the Simpliziti application.
Aggregate Information; Cookies, Web Beacons, Clear Gifs, and IP Addresses
Simpliziti may automatically collect data and information about You, Your website usage patterns and
similar information that is not Personal Information as You navigate the Website, the Software or
the SaaS. On an aggregate basis only, Simpliziti collects comprehensive demographic, business
information and data, and other non-identifying information about users of the Website. Simpliziti
will never disclose any Personal Information as part of this aggregate information but Simpliziti
may lend, sell, share or otherwise disclose aggregate information with others so Simpliziti can
perform research and provide the results to third parties, enhance and market the Website, the
Software and the SaaS, and conduct accounting and process record keeping functions.
Simpliziti may also use a feature of Your browser called a cookie. Your cookie automatically identifies Your computer - but not You - to our servers when You visit the Website and allows Simpliziti to correlate Your computer with certain usage patterns which are stored in Simpliziti’s log files. Simpliziti uses cookies to gather general, aggregate statistics about the overall popularity and usage of the Website. Simpliziti also uses more temporary cookies, often referred to as session cookies, to keep a user logged into the system and aid in the exchange of information between pages without loss of data. Such a cookie, however, is only stored for the current browsing session and is deleted once the browser is closed. Simpliziti can also only read cookies from the Website. Search for Cookies under Your Web browser's Help menu for more information on cookie management features available to You. If Your browser is set to reject all cookies, the Website and Services may not function properly.
Additionally, Simpliziti may use IP address information to count and track aggregate visits to Website, to help diagnose problems with its server, and to administer the Website and Services. Simpliziti does not link IP addresses to anything personally identifiable so while a particular user’s session can be tracked, the user remains completely anonymous.
Other websites and links
Links to other third party websites may be included on the Website. These third parties have
separate data collection and privacy practices independent from Simpliziti’s, and Simpliziti
cannot be responsible for their policies or activities. Please contact those third parties directly
if you have questions about their privacy policies. Simpliziti does not control these third party
websites and/or links.
Accessing and Updating Information
Simpliziti does not currently have an online method for users to delete their Personal Information
contained in its database. However, You may change or update the Personal Information Simpliziti has
collected, request that Simpliziti deletes it, or request that Simpliziti changes how it uses such
Personal Information by sending an email to [email protected] with Your instructions.
Please note that any changes may impact prior transactions performed on the Website.
Changes to this Privacy Policy
Simpliziti encourages You to review the Privacy Policy not just the first time You visit the Website
but periodically afterwards, as it may be modified from time to time. The date of the last update of
the Privacy Policy will always be posted below:
THIS PRIVACY POLICY WAS LAST REVISED ON DECEMBER 14, 2015.
If Simpliziti makes any substantive changes to this Privacy Policy in the future with regard to how Simpliziti uses Your Personal Information, Simpliziti will incorporate those changes here. Your continued use of the Website after the changes are posted constitutes Your agreement to the changes, both with regard to information previously collected from You and with regard to information Simpliziti collects from You in the future. If You do not agree to the changes, please discontinue use of the Website. Lastly, if Simpliziti is sold or merged with another company, Your Personal Information will be included as part of the sale and disclosed to the purchaser, but unless You are notified that the Privacy Policy is changed, Your Personal Information will be maintained in the same manner.
International Users
Like almost every website and mobile application software, the Website, Software and SaaS are
accessible around the world. By visiting the Website, downloading the Software or using the SaaS and
providing Your information, You acknowledge and agree that Your Personal Information can be stored
for the purposes identified in this Privacy Policy. Simpliziti processes and stores your information
in the United States and Your information may be stored on servers located outside Your residential
jurisdiction and which may have less stringent privacy practices than Your own. If You access the
Website from outside the United States, Your usage of the Website constitutes consent to the
transfer of Your data outside of your country and to the United States.
Security
This Website, the Software and the SaaS have industry-standard security measures in place to protect
the loss, misuse, and alteration of the information under Simpliziti’s possession, custody or
control, and Simpliziti makes good faith efforts to store Your Personal Information in a secure
operating environment consistent with industry standards. Unfortunately, no data transmission over
the Internet can be guaranteed to be absolutely secure. As a result, while Simpliziti strives to
protect Your Personal Information, Simpliziti cannot ensure or warrant the security of any
information You transmit to us, and You do so at your own risk. If Simpliziti provides You with a
user name and password to access portions of the Website or as part of Your subscription, Simpliziti
disclaims any responsibility for a breach of privacy as a result of Your willingly or inadvertently
disclosing Your user name and password to others.
The Personal Information collected by Simpliziti is securely stored in the database. At no time do we collect financial information. The database is located within a secure environment, which is located in a facility with certifications such as: Payment Card Industry (PCI) Data Security Standard (DSS) Level 1, ISO 9001, ISO 27001, and SOC, amongst others.
